Terms and Conditions
1. Scope
The following Terms and Conditions apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed in nature. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed professional activity.
2. Contracting Party, Contract Conclusion, Correction Options
The purchase contract is concluded with Altura Interactive Solution - FZCO, IFZA Properties, Building A1, Dubai Digital Park, Dubai Silicon Oasis, United Arab Emirates, represented by Emilio Jenko.
By listing products in the online shop, we make a binding offer to conclude a contract for these items. You may initially add our products to the shopping cart on a non-binding basis and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the order button. Immediately after submitting your order, you will receive a confirmation by email.
3. Contract Language, Storage of Contract Text
The language(s) available for concluding the contract: German, English, French, Spanish, Italian
We save the contract text and send you the order data and our Terms and Conditions in text form. For security reasons, the contract text is no longer accessible via the internet.
4. Delivery Terms
All products offered in this shop are either sent by email, are downloadable products, or are services.
We generally do not ship products by post.
Shipping is free of charge as a rule.
5. Payment
The following payment methods are generally available in our shop:
Credit Card
You provide your credit card details during the ordering process. Your card will be charged after the goods have been dispatched.
PayPal
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your login credentials, and confirm the payment instruction. The payment transaction is processed by PayPal after the goods have been dispatched. Further information is provided during the ordering process.
Google Pay
To pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have the Google Pay feature activated, authenticate yourself with your login credentials, and confirm the payment instruction. The payment transaction is processed immediately after the order is placed. Further information is provided during the ordering process.
Apple Pay
To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have the Apple Pay feature activated, authenticate yourself with your login credentials, and confirm the payment instruction. The payment transaction is processed immediately after the order is placed. Further information is provided during the ordering process.
6. Cancellation / Refund
Cancellation is possible at any time before processing has begun!
A refund is no longer possible once the service has been rendered!
Any applicable fees will only be refunded in the event of a withdrawal or an error on our part.
7. Warranty and Guarantees
Unless expressly agreed otherwise below, the statutory law on defects shall apply.
For used goods: if the defect occurs after the expiry of one year from delivery of the goods, claims for defects are excluded. Defects that occur within one year of delivery of the goods may be asserted within the statutory limitation period of two years from delivery of the goods.
The above limitations and shortened time limits do not apply to claims for damages caused by us, our legal representatives, or agents
• in cases of injury to life, body, or health
• in cases of intentional or grossly negligent breach of duty, as well as fraudulent concealment
• in cases of breach of essential contractual obligations, the fulfilment of which is a prerequisite for the proper performance of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)
• within the scope of a guarantee promise, to the extent agreed, or
• to the extent that the scope of the Product Liability Act is applicable.

8. Liability
For claims based on damages caused by us, our legal representatives, or agents, we are always liable without limitation
• in cases of injury to life, body, or health
• in cases of intentional or grossly negligent breach of duty
• in cases of guarantee promises, to the extent agreed, or
• to the extent that the scope of the Product Liability Act is applicable.
In the event of a breach of essential contractual obligations, the fulfilment of which is a prerequisite for the proper performance of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations), caused by slight negligence on our part, our legal representatives, or agents, liability shall be limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.
9. Dispute Resolution
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board. For any disputes arising from these Terms and Conditions or the use of our online shop, the place of jurisdiction shall be Dubai, United Arab Emirates, to the extent permitted by applicable law.
